Justin is seeking to recover losses for a class of iPhone purchasers. It is alleged that Apple abused their dominant position in the phone and phone software markets by engaging in abusive conduct, viz. selling iPhones with defecting lithium ion batteries, concealing this fact from consumers, and continuing to market and sell such defective products.

Justin is seeking to recover losses for customers who paid a Loyalty Penalty. This occurs at the end of the minimum term of a combined handset and airtime Contract if customers don’t terminate their contract and continue to pay an amount in excess of the amount payable for airtime services despite the fact that their handset has been paid off in full.

Justin sought to recover losses for a class of train passengers who he said were charged twice for part of their journeys by certain train operating companies.
